1. Who we are

By using the Site or placing an order, you agree to these Terms.

2. Adults only

The Site and its products are for adults only. You must be at least 21 years old (and of legal age where you live) to access the Site or buy from us. By placing an order you confirm you meet this requirement. We may cancel any order if we reasonably believe the buyer is underage.

3. Personal use only, no resale

Products are sold to end customers for personal use only. Buying for resale is not allowed, and we may refuse or cancel orders that appear to be for resale (for example, unusually large quantities or repeated orders of the same item).

4. State and local restrictions

Some U.S. states and localities restrict the sale of certain adult products. You’re responsible for making sure your purchase is legal where it will be delivered. We may refuse, limit or cancel orders to any place where we believe a sale would be restricted, and we’ll refund those orders in full. We ship only within the United States.

5. Products and descriptions

Products are sourced from U.S. distributors and ship directly from their warehouses. Descriptions, images, materials and specifications come from the manufacturer or distributor and are provided in good faith. Colors and appearance may vary slightly. Products are adult novelties and personal-care items, not medical devices, and are not meant to diagnose, treat, cure or prevent any condition. Always follow the manufacturer’s instructions and warnings, and stop using any product that causes discomfort.

6. Orders, pricing and cancellation

Prices are in U.S. dollars. Applicable sales tax and shipping are shown at checkout.
Placing an order is an offer to buy. We may accept or decline it. An order is accepted when it ships.
We may cancel an order for reasons including suspected fraud, pricing or listing errors, products being unavailable from our distributors, or shipping restrictions. If we cancel after you’ve paid, we refund you in full.
You can ask us to cancel an order that hasn’t shipped by emailing elite305studio@gmail.com.

7. Payment and billing descriptor

Payment is taken when you order and is processed by a third-party payment processor. We don’t store full card numbers. Charges appear on your statement as Elite 305 (possibly together with the processor’s name).

8. Shipping and returns

Our Shipping Policy and Returns & Refunds Policy are part of these Terms.

9. Disputes and chargebacks: contact us first

If there’s a problem with your order, contact us at elite305studio@gmail.com or +1 305-710-6773 before you dispute the charge with your bank. We respond within 2 business days and will try in good faith to fix it (by replacement, refund or other resolution). This doesn’t limit any rights you have under law or your card agreement. Opening a chargeback for an order you received as described, without contacting us first, may lead us to contest the dispute with your order and delivery records and to refuse future orders.

10. Acceptable use

Don’t misuse the Site. That includes attempting unauthorized access, scraping, interfering with its operation, or using another person’s payment method without permission.

11. Disclaimer and limitation of liability

To the fullest extent the law allows, the Site and its content are provided “as is.” Products are covered only by any warranty their manufacturer provides, and we’ll help you make warranty claims. To the fullest extent the law allows, Elite 305 Studio is not liable for indirect, incidental, special or consequential damages, or for damage caused by misuse or by not following manufacturer instructions. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that can’t be limited by law.

12. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts in Miami-Dade County, Florida, unless applicable law requires otherwise.

13. Changes

We may update these Terms from time to time. The version posted when you order applies to that order.
